Can I sell to European customers if I am not based in Europe?

Yes. Nothing stops a seller outside Europe from selling to European buyers. What changes is the VAT on the sale, and whose job it is to deal with it.

Behind the question there is usually a second one: do I have to set up a company in Europe first. You do not.

Do I need a European company?

No. Registering a company in Europe is one way to handle European VAT. It has never been a condition of selling to European buyers.

The two questions get mixed together, which is why so many people conclude they are locked out. Selling is not the obstacle. The tax admin is.

What actually changes

VAT on a digital product follows the buyer, not you. If your buyer is in the EU, the rate that applies is the one in the buyer's country, whichever country you are sitting in.

Your nationality does not come into it. Nor does your company's address. What decides it is where the buyer is, and whether your product reaches them automatically. How is my online course taxed in Europe covers that second test.

The three jobs somebody has to do

  • Charge the right rate. The buyer's rate, not yours. Each member state sets its own.
  • Prove where the buyer was. Two pieces of evidence that do not contradict each other, captured at the moment of sale. Reconstructed afterwards, it does not count.
  • Register, file and keep the records. There is a single EU registration that covers sales into every member state, so it is one return instead of one per country. Sellers established outside the EU can use it too.

All three have to happen on every sale. The only real question is whether you are the one doing them.

What stays yours either way

Your own tax position. Money you are paid is income where you live, and you deal with it there as you always have. A merchant of record takes the EU VAT on the sale off your hands. It does not touch your own tax return.
